ATTENTION: OBLIGATORY FOR ALL: "Autodichiarazione per gli spostamenti"!

The Prime Minister's decree of 8 March provides for heavy fines and penalties for those who do not comply with the rules and provisions prescribed. These provisions were followed by the rules contained in the DCPM of 9 March aimed at extending the measures envisaged for the red zone to the whole national territory. Up to 3 months imprisonment and a 206 euro fine for those who do not comply with the obligations imposed to deal with the coronavirus emergency. For shops, restaurants and bars that disregard the prescribed rules, commercial activity is suspended. Penalties also for those who drive without self-declaration and for false declarations. Below is a summary of the main irregularities that can be sanctioned until April 3 on the whole national territory.



Penalties on travel limits

In case of violation of the rules that limit travel, the sanction provided for in article 650 of the criminal code is provided. According to the rule of the penal code, in case of non-compliance with an order of an authority, the sentence of up to 3 months or a fine of up to 206 euros is foreseen. The most serious offense hypothesis that can be configured is that described in article 452 of the penal code which punishes culpable crimes against public health which pursues all conducts capable of producing a danger to public health. On the basis of the Interior Ministry Directive, the prefect is responsible for monitoring compliance with the measures relating to the various municipal administrations.



What is the risk of someone who violates the quarantine?

What is the risk of someone who violates the quarantine period, that is, the period of isolation from their home? In addition to compromising one's own health and that of the whole community, it contributes significantly to the collapse of the health system put to the test by the spread of coronavirus. Also in this case, the crime referred to in article 650 of the criminal code is configured; this provides for a prison sentence of up to 3 months or a fine of up to 206 euros unless a more serious offense occurs. Think for example of article 452 of the penal code, or culpable crimes against public health, with imprisonment from 3 years to 12 years.

Penalties for bars, restaurants, shops and shopping malls that do not respect timetables

Various penalties are imposed for commercial categories such as restaurants, food stores and pharmacies or bars. Those who manage these activities are required to prepare the necessary conditions to ensure that the citizen is guaranteed the minimum safety distance between people of at least 1 meter.
